Legal Glossary: Dismissal


Similar to an acquittal, a dismissal involves a decision from the bench that your case should not move forward. Reasons can include a lack of evidence and bad faith on the part of the prosecutor or law enforcement. When the defense files a motion to dismiss, a judge or magistrate has already determined that the case should proceed. The defense attorney claims that the decision was in error, but so long as the prosecutor has some evidence that they can present, the case will probably move forward.
