Legal Glossary: Sentencing


Sentencing occurs after a defendant has either entered a plea of guilty, no contest, or has been found guilty by a jury. Under California law, the defense and the prosecution each can present arguments with regards to sentencing. A defense attorney will provide evidence for mitigating circumstances, while the prosecutor will provide evidence for aggravating circumstances.
